Duties & Responsibilities
Position Summary: The position is responsible for the provision of in-house advisory, interpretive and administrative services regarding legal matters, ensuring compliance to relevant legislation and regulations to support the attainment of the objects of the Profession Act.The Executive: Legal Services reports to the Chief Executive Officer.
Key Performances Areas
- Formulate the Division’s Annual Business Plan in line with the Strategy and Annual Performance Plan;
- Advise the Council, CEO and Executives in all corporate legal matters, Engineering Profession Act 46 of 2000 and other legislation;
- As a member of the Executive team, work with Council, its Executive Committee (EXCO) and other Council Committees;
- Conduct and/or oversee legal research and comparative benchmarking for informed legal positioning, including provision of in-house or outsourced legal opinions;
- Oversee the approvals of Legal Services Panel of Lawyers, including rotational appointments;
- Oversee the content of Legal information disseminated externally, including information on the Website;
- Oversee the drafting and vetting of Legal documents;
- Oversee the entire appeal process value chain: Registration; Qualifications Evaluation as well a Professional Conduct appeals;
- Develop Legal Enforcement and Compliance mechanisms for unregisteredjuristic and natural personsas per the provisions of the Engineering Profession Act 46 of 2000 to ensure safe engineering practises;
- Represent in matters pertaining to the review of legislation and associated Rules and Regulations;
- Manage and create a conducive environment for highly motivated and productive staff for the Division;
- Prepare and monitor the divisional budget requirements based on organisational developments and business needs;
- Observe and comply with corporate governance policies and protocols.
Desired Experience & Qualification
- Bachelor of Law Degree or equivalent;
- Postgraduate qualification in management;
- Admission as an Attorney/Advocate;
- A minimum of 10 years’legal experience, with 5 years’ at a senior management level;
- Advanced written, verbal communication and negotiations skills;
- Understanding of the general application of legislation governing statutory councils;
